Terms of Service, Warranties & Legal Disclaimer

1. Scope of Services

York Region Web Studio provides custom web development, domain configuration, visual design, and website management services. Project deliverables and timelines (including 48-hour turnarounds) begin once all necessary client assets (logos, images, and text copy) are delivered.

2. Hosting & Maintenance Retainers

Monthly recurring retainers ($10 CAD, $39 CAD, or $69 CAD/month depending on package level) cover high-speed hosting, security maintenance, domain renewal management, and software updates. Retainers are billed monthly and may be canceled with 30 days written notice. In the event of subscription cancellation, site files will be provided to the client for self-hosting transition.

3. Intellectual Property & Content Ownership

Upon final settlement of project invoice fees, the client retains full ownership of all custom text, branding elements, and client-supplied photo assets. York Region Web Studio retains rights to proprietary code layouts and reserves the right to display completed projects in promotional portfolio materials unless restricted by prior non-disclosure agreement (NDA).

4. Limited Warranty & Bug Fix Guarantee

All delivered custom websites include a 30-day post-launch warranty covering display bug fixes, functional form errors, and layout misalignments across supported browser platforms at no additional charge. This warranty does not cover issues caused by third-party code modifications, unauthorized script installations, or third-party API changes.

5. Legal Disclaimer & Limitation of Liability

Websites and technical setups are provided on an "as is" and "as available" basis. York Region Web Studio makes no guarantees regarding specific search engine rankings, lead generation volumes, or third-party platform uptime. To the maximum extent permitted by the laws of Ontario and Canada, York Region Web Studio shall not be liable for indirect, incidental, or consequential damages resulting from website downtime, server outages, or third-party service failures.

6. Governing Law

These terms and all service agreements are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
